La Asociación para la Recuperación de la Memoria Histórica desentierra en una fosa en el pueblo de Milagros 42 cuerpos fusilados. Estos fueron asesinados por falangistas en las primeras semanas de Septiembre de 1936,se han encontrado casquillos de mauser del 35 y 36,disparos en la cabeza y multitud de huellas de muerte violenta,así como restos de cal,gafas,cristales, monedas,hebillas de cinturón,botas,etc. La mayoría son alcaldes,concejales o destacados sindicalistas y vecinos de la Ribera del Duero,eliminados con el objetivo de vencer por mucho tiempo. Uno de los esqueletos pertenece a un vecino de 16 años. Según los datos los ejecutados en la comarca suponen del 1% al 3% de las poblaciones. Los datos y la imagen de la fosa abierta refleja la magnitud y crudeza de aquella matanza. A civiles,en la retaguardia y a muchos kilómetros del frente.
El representante comarcal de la ARMH, José María Rojas, confirma que pese a que cuando en agosto de 2007 se localizó el enterramiento milagreño y afloraron los primeros restos óseos, se personó la Guardia Civil y la policía judicial para tomar datos, no han hecho nada al respecto. De hecho hace algo más de un mes el propio Rojas llevó al juzgado la comunicación de que iban a comenzar la exhumación «y no hemos recibido ninguna noticia al respecto, se han inhibido totalmente».Rojas asegura que desde que se conoció la inhibición de Garzón ha acudido en varias ocasiones al juzgado para interesarse por la cuestión y saber si iban a tomar cartas en el asunto «y hasta ahora no han dado señales de vida y no han dicho ni Pamplona, como la inmensa mayoría de los juzgados». El propio Rojas tiene desde hace dos años un cráneo y una tibia,desde que acudió con pico y pala para localizar la fosa y hacer la prueba del carbono 14. A los pocos días apareció una patrulla de la Guardia Civil con una denuncia del Ayuntamiento de Milagros por "expolio arqueológico",trás comprobar que eran de la Guerra Civil se los devolvieron. No solo la animadversión del Alcalde de Milagros y los impedimentos del juzgado, ningún juez se ha pasado por el lugar. Las familias víctimas del franquismo ven en esta exhumación total desamparo. El total fracaso de la Ley para la Memoria de 2007.
La exhumación dirigida por el profesor de Medicina Forense de la Universidad del País Vasco, Francisco Etxeberría. El especialista que más exhumaciones de fosas de la represión franquista ha llevado a cabo hasta el momento y que recientemente estudió en Santiago de Chile los restos del cantante Víctor Jara, asesinado por la dictadura pinochetista. El equipo de la exhumación está compuesto por una veintena de arqueólogos y antropólogos,algunos de ellos venidos de otros países como Chile, Canadá y Colombia.
